BASIC PROVISIONS
2.1 Hungarian law shall govern the matters not regulated in these Rules and the interpretation of these Rules, in particular with regard to the relevant provisions of Act V of 2013 on the Civil Code (“Civil Code”) and Act CVIII of 2001 on certain issues of electronic commerce services and information society services (Elker. tv.). The binding provisions of the relevant legislation shall apply to the parties without any specific stipulation.

2.2 These Rules shall enter into force on 1 September 2021 and shall remain in force until revoked. The Service Provider shall be entitled to unilaterally amend these Regulations. The changes shall take effect as of their publication in the webshop. By using the Websites, Users accept that all the Regulations relating to the use of the Websites shall automatically apply to them.

2.3 By accessing the webshop website operated by the Service Provider or by reading its content in any way, even if the User is not a registered user of the webshop, the User acknowledges that he/she is bound by the provisions of the Regulations. If the User does not accept the Terms and Conditions, he/she is not entitled to view the content of the webshop.

2.4 The Service Provider reserves all rights in respect of the webshop website, any part of it and the content displayed on it, as well as the distribution of the website. The downloading, electronic storage, processing and sale of the contents of the website or any part thereof without the prior written consent of the Service Provider is prohibited.

3.a SCOPE OF PRODUCTS AVAILABLE FOR PURCHASE

3.a.1. The products displayed can only be ordered online. The prices displayed for the products are in HUF and include the statutory VAT, but do not include delivery charges. The Service Provider does not charge extra for packaging.

3.a.3. The pictures displayed on the product data sheets may differ from the real ones, they are provided as illustrations. We are not responsible for any discrepancy between the images displayed in the webshop and the actual appearance of the products.

3.b SCOPE OF SERVICES AVAILABLE FOR PURCHASE

Orders are considered to be contracts concluded by electronic means, which are subject to payment and which are governed by Articles 5 and 6 of Act CVIII of 2001 on certain aspects of electronic commerce services and information society services.

In the case of an order, the conclusion of the contract shall be carried out in accordance with Article 4(10) of Government Decree No. 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses. The contract is concluded by the consumer by placing the product in the shopping cart, filling in the order form and then making the payment.

Please note that we invoice our customers on the samlazz.hu website. In accordance with the provisions of Article 175 (2) (b) of Act CXXVII of 2007, you acknowledge that invoices will be sent in pdf format by email. By accepting the ASZF, the buyer agrees to receive an electronic invoice, which will be sent in PDF format to the email address provided by the buyer and printed out by the buyer.

Upon payment for the product, the publication will be at the Buyer’s disposal and at the Buyer’s disposal.

ORDERING PROCEDURE IN THE ONLINE SHOP
4.1 The User may purchase in the webshop without registration or logs into the webshop after registration.

4.2. Add the product you wish to purchase to the shopping cart by clicking on the cart icon or the “add to cart” button, the system will automatically navigate to the shopping cart page

4.3. If you do not wish to purchase any further items, please check the number of items you wish to purchase. Click on the “Remove product” button (x icon) to delete the product. Once you have entered the quantity, click on the “Update cart” button to see the amount to be paid for the products.

4.6. The provision of billing information is mandatory in all cases. The delivery address is required if you request delivery to an address from your billing address. If you register on the site, you will be able to track the status of your order and, if you have registered, you may not need to re-enter your details if you place a new order.

4.8 Once you have provided your details, you can submit your order by clicking on the “Submit Order” button, but before doing so you must read and accept these GTC (General Terms and Conditions) and the Privacy Policy as set out in the GDPR guidelines. You can read the Terms and Conditions and the Privacy Policy by clicking on the link provided, and you must accept them in order to make a purchase by ticking the boxes at the bottom of the page.

4.9. Correction of data entry errors: the User can always return to the previous phase before completing the order process, where he can correct the data entered. If you find an error in the data entered after submitting your order, please contact hello@com-pot.hu. It is important to make sure that the data is accurate, as the product will be invoiced and shipped based on the data you have entered.

4.10 In the case of credit card purchases, we will start processing your order immediately. The package is usually assembled within 3-4 working days.

4.11 In the event of a technical error or human error in the webshop, we reserve the right to correct any product information or prices. In such a case, we will inform the customer of the new information immediately after the error has been detected or corrected. The buyer may then confirm the order once more or either party may withdraw from the contract.

4.12 The total amount payable is inclusive of all charges based on the order summary and confirmation letter. Please inspect the parcel on delivery, in case of damage you are not obliged to accept the parcel and ask for a report to be made in case of damage to the products. In this case, do not take the parcel! In the case of damage resulting from delivery, we are unable to accept any subsequent complaints without a report.

PROCESSING AND FULFILMENT OF ORDERS IN THE ONLINE SHOP
5.1. Orders are processed on working days, usually between 9:00 and 16:00. It is also possible to place an order outside the times indicated as order processing times, if it is placed outside these times, it will be processed on the following working day.

5.2 We will always confirm by e-mail when we will fulfil your order. General delivery time: within 5-10 working days. We are not liable for unannounced changes or delays due to reasons beyond our control.

5.3 If the Service Provider fails to fulfil its contractual obligations because the product specified in the contract is not available, it shall immediately inform the User thereof and refund the amount paid by the User without delay, but no later than within 30 days. The fulfilment of this obligation shall not relieve the Service Provider of any other consequences of its breach of contract.

RIGHT OF WITHDRAWAL
6.1 Pursuant to the provisions of Directive 2011/83/EU of the European Parliament and of the Council and Government Regulation 45/2014 (26.II.26) on the detailed rules for contracts between consumers and businesses, the User may withdraw from the contract within 14 days of receipt of the ordered product without giving any reason and must return the ordered product.

6.2 The period for exercising the right of withdrawal shall expire 14 days after the day on which the User or a third party other than the carrier and indicated by the User takes delivery of the goods. This does not affect the User’s right to exercise his right of withdrawal as provided for in this clause during the period between the date of conclusion of the contract and the date of receipt of the goods. In the event of a dispute, the burden of proof that the time limit has been observed shall lie with the User.

6.3 The cost of returning the product must be borne by the consumer, the company does not assume the cost of this cost. The buyer must exercise the right of withdrawal in good faith and fairly. If this is not the case, for example if the buyer does not immediately decide to return the product ordered and starts using it, he must pay for any loss of value caused by the product.

6.4 In the event of exercising the right of withdrawal, the User shall not be charged any costs other than the cost of returning the product, but the Service Provider may claim compensation for material damage resulting from improper use.

6.5 The Service Provider shall reimburse the User the amount paid, including the delivery charges, immediately upon the return of the product in accordance with the above legislation, but within 14 days at the latest (excluding any additional costs incurred due to the fact that the User has chosen a mode of transport other than the cheapest usual mode of transport offered by the Service Provider).

6.12. The User must pay particular attention to the proper use of the product, as the User is liable for any damage resulting from improper use!

What products are not covered by the right of withdrawal?

6.13. The User may also contact the Service Provider with any other complaints using the contact details provided in these Rules.

6.14. The right of withdrawal does not apply to entrepreneurs/companies, i.e. persons acting in the course of their profession, self-employment or business activity, i.e. not as consumers or end-users.

WARRANTY, GUARANTEE
The products sold in the webshop to customers who are consumers (end users), depending on the type of product and the purchase price, have a different mandatory warranty and/or guarantee period in accordance with the legislation in force (Government Decree 151/2003 (IX.22.)). The seller’s warranty and guarantee liability is governed by the Civil Code and Government Decree 151/2003 (22.IX.2003). The mandatory 1-year warranty under the current legislation only applies to certain products listed in the Annex to Government Decree 151/2003 (IX. 22.) with a gross sales price of over HUF 10,000.00.

MIXED PROVISIONS
9.1 The Service Provider shall be entitled to use an intermediary to fulfil its obligations. 9.1.1 The service provider may engage the services of a service provider’s vicarious agent.

9.2 If any part of these Terms and Conditions becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining parts shall not be affected.

9.3 If the Service Provider fails to exercise its rights under the Rules, the failure to exercise such rights shall not be deemed a waiver of such rights. No waiver of any right shall be valid unless expressly stated in writing. The fact that the Service Provider does not strictly adhere to a material term or condition of the Terms and Conditions on one occasion does not mean that it waives its right to insist on strict adherence to that term or condition in the future.

9.4 The Service Provider and the User shall attempt to settle their disputes amicably. The competent conciliation body is an independent body attached to the regional chambers of commerce and industry, the purpose of which is to attempt to settle the dispute between the consumer and the economic operator by amicable means.

We are committed to using an alternative dispute resolution forum to resolve your consumer disputes. You can access the online dispute resolution platform developed and operated by the European Commission by clicking on the link:

Using the online dispute resolution platform requires registration with the European Commission, and once logged in, consumers can submit a complaint via the website if they have not been able to resolve their dispute directly with the business.

Once the complaint has been submitted, the online dispute resolution platform immediately forwards it to the other party. The parties concerned will then have to agree on an alternative dispute resolution forum which will ultimately adjudicate on the case between them. The platform will inform the parties of the fora that may act in their case. Once agreement is reached on the dispute resolution forum, the online platform will forward the complaint to it.

If the parties fail to reach an agreement within 30 days, or if the platform is unable to identify an alternative dispute resolution forum with jurisdiction to act on the basis of the information provided, the complaint will not be processed further.

COMPLAINTS HANDLING PROCEDURE
10.1 Our Store aims to fulfil all orders to a satisfactory quality and to the full satisfaction of the customer. In the event that the User has a complaint regarding the contract or its performance, he/she may send his/her complaint to hello@com-pot.hu.

10.2 Our webshop will reply to the written complaint in writing within 30 days. The reasons for rejecting the complaint will be given. A copy of the reply will be kept for 3 years and presented to the control authorities upon request.

AUTHOR’S RIGHTS
11.1 As the website com-pot.hu,compostcomposter.com/compostcomposter.hu is a copyrighted work, it is prohibited to download (reproduce), retransmit to the public, use in any other way, store electronically, process and sell the content of the website or any part thereof without the written consent of the Service Provider. Otherwise, we will initiate legal proceedings in accordance with the applicable legislation – Act LXXVI of 1999 and Article 385 of Act C of 2012 – and the daily fee for unauthorised use will be charged. The fee is HUF 300,000/day/image/video/sentence.

2. ALAPVETŐ RENDELKEZÉSEK

2.1. A jelen Szabályzatban nem szabályozott kérdésekre, valamint jelen Szabályzat értelmezésére a magyar jog az irányadó, különös tekintettel a Polgári Törvénykönyvről szóló 2013. évi V. törvény („Ptk.”) és az elektronikus kereskedelmi szolgáltatások, valamint az információs társadalommal összefüggő szolgáltatások egyes kérdéseiről szóló 2001. évi CVIII. (Elker. tv.) törvény vonatkozó rendelkezéseire. A vonatkozó jogszabályok kötelező rendelkezései a felekre külön kikötés nélkül is irányadók.

2.2. A jelen Szabályzat 2021. szeptember1.  napjától hatályos és visszavonásig hatályban marad. A Szolgáltató jogosult egyoldalúan módosítani a Szabályzatot. A változások a webáruházban történt megjelenésüktől lépnek életbe. Felhasználók a weboldalak használatával elfogadják, hogy rájuk nézve a weboldalak használatával kapcsolatos valamennyi szabályozás automatikusan érvényes.

2.3. A Felhasználó, amennyiben belép a Szolgáltató által üzemeltetett webshop weboldalra, vagy annak tartalmát bármilyen módon olvassa – akkor is, ha nem regisztrált felhasználója a webshopnak –, a Szabályzatban foglaltakat magára nézve kötelezőnek ismeri el. Amennyiben a Felhasználó nem fogadja el a feltételeket, nem jogosult a webshop tartalmának megtekintésére.

2.4. A Szolgáltató fenntart magának minden jogot a webshop weboldal, annak bármely részlete és az azon megjelenő tartalmak, valamint a weboldal terjesztésének tekintetében. Tilos a weboldalon megjelenő tartalmak vagy azok bármely részletének letöltése, elektronikus tárolása, feldolgozása és értékesítése a Szolgáltató előzetes írásbeli hozzájárulása nélkül.

3.a A MEGVÁSÁROLHATÓ TERMÉKEK KÖRE

3.a.1. A megjelenített termékek kizárólag online rendelhetők meg. A termékekre vonatkozóan megjelenített árak forintban értendők, tartalmazzák a törvényben előírt áfát, azonban nem tartalmazzák a szállítás díját. Csomagolási költséget külön a Szolgáltató nem számít fel.

3.a.2. A com-pot.hu webáruházban agyagedény és hozzá kapcsolódó kiegészítők találhatóak.

3.a.3. A webshopban a Szolgáltató részletesen feltünteti a termék nevét, leírását, a termékekről fotót jelenít meg. A termékek adatlapján megjelenített képek eltérhetnek a valóságostól, illusztrációként szerepelnek. Nem vállalunk felelősséget a webshopban megjelenő képek és a termékek tényleges kinézete miatti különbözőség miatt.

3.a.5. Akciós ár bevezetése esetén a Szolgáltató teljes körűen tájékoztatja Felhasználókat az akcióról és annak pontos időtartamáról.

3.b A MEGVÁSÁROLHATÓ SZOLGÁLTATÁSOK KÖRE

A megrendelések elektronikus úton megkötött szerződésnek minősülnek, amely fizetési kötelezettséggel jár, és amelyre az elektronikus kereskedelmi szolgáltatások, valamint az információs társadalommal összefüggő szolgáltatások egyes kérdéseiről szóló 2001. évi CVIII. törvény 5. és 6. §-ában foglaltak irányadóak.

Megrendelés esetén a szerződéskötés a fogyasztó és a vállalkozás közötti szerződések részletes szabályairólszóló 45/2014. (II.26.) Kormányrendelet 4. § (10) bekezdése alapján történik meg. A szerződést a fogyasztó a termék kosárba helyezésével, megrendelő űrlap kitöltésével majd a fizetéssel köti meg.

Tájékoztatjuk, hogy ügyfeleink részére a szamlazz.hu oldalán állítjuk ki számláit. A 2007. évi CXXVII törvény 175. § (2) bekezdés b) pontjában foglaltak figyelembevételével tudomásul veszi, hogy az számlákat.pdf formátumban, email útján küldjük el. Az ASZF elfogadásával a vevő elfogadja,hogy elektronikus számlát kap, amely akként kerül megvalósításra,hogy a számla az általa megadott email címre kerül PDF formátumbanmegküldésre, melyet a vásárló nyomtat ki.

 A termék kifizetésével egyidejűleg a Vevő tulajdonába és rendelkezésébe kerül a kiadvány.

4. RENDELÉS MENETE A WEBÁRUHÁZBAN

4.1. A Felhasználó regisztráció nélkül vásárolhat a webshopban vagy a regisztrációját követően bejelentkezik a webshopba.

4.2. A megvásárolni kívánt terméket a kosár ikon vagy a „kosárba rakom” gomb megnyomásával helyezze a kosárba, ezt követően a rendszer automatikusan a kosár oldalra navigálja

4.3. Amennyiben szeretne további terméket kosárba helyezni, válassza a „Vásárlás folytatása” gombot. Ha nem szeretne további terméket vásárolni, ellenőrizze a megvásárolni kívánt termék darabszámát. Az „termék eltávolítása” gombra (x ikon) kattintva törölheti az adott terméket. Mennyiség megadását követően a „Kosár frissítése” gombra kell kattintania, ekkor láthatóvá válik a termékekért fizetendő összeg.

4.4. Ezen az oldalon legörgetve, kiválaszthatja a szállítási módot is (a kis kijelölő ikon segítségével), így láthatja a rendelés szállítási díjjal növelt végösszegét. A szállítási költségek az alábbiak szerint alakulnak:

A rendelés teljesítése kizárólag a termék értékének kiegyenlítése után történik meg. A szállítás személyes ávétellel vagy a Gólya Futárszolgálaton keresztül történik. ADATKEZELÉSI TÁJÉKOZTATÓ

4.6. A számlázási adatok megadása minden esetben kötelező. A szállítási cím megadása akkor szükséges, ha a számlázásitól címre kéri a szállítást. Amennyiben regisztrál az oldalra, a későbbiekben nyomon tudja követni rendelése státuszát, illetve újabb rendelés esetén – amennyiben belépett – nem feltétlenül szükséges újfent megadni adatait.

4.7. Amennyiben személyes átvétellel kéri a kiszállítást a Pénztár oldalon ki tudja választani az Önhöz legközelebb átvételi pontot.

4.8. Az adatok megadását követően a „Megrendelés elküldése” gombra kattintva tudja elküldeni megrendelését, előtt azonban el kell olvasnia és elfogadnia a jelen  ÁSZF-et (Általános Szerződési Feltételek) és a GDPR irányelvek szerint megfogalmazott adatvédelmi tájékoztatóban foglaltakat. Az ÁSZF-et és az adatvédelmi tájékoztatót a megadott linkre kattintva el tudja olvasni, a vásárláshoz elfogadásuk kötelező, ehhez kipipálni szükséges a jelölőnégyzeteket az oldal alján.

4.9. Adatbeviteli hibák javítása: a Felhasználó a megrendelési folyamat lezárása előtt minden esetben vissza tud lépni az előző fázisba, ahol javítani tudja a bevitt adatokat. Ha a megrendelés elküldését követően hibát észlel a megadott adatokban, írjon a hello@com-pot.hu címe! Fontos, ügyeljen az adatok pontosságára, hiszen a megadott adatok alapján kerül számlázára, illetve szállításra a termék.

4.10 Bankkártyás vásárlási mód esetén azonnal megkezdjük a rendelés feldolgozását. A csomag összeállítását általában 3-4 munkanapon elvégezzük.

4.11 Amennyiben a webshopban technikai hiba vagy emberi mulasztás lép fel a terméktájékoztatásnál vagy az áraknál, fenntartjuk a jogot a korrekcióra. Ilyen esetben a hiba felismerése, illetve módosítása után azonnal tájékoztatjuk a vevőt az új adatokról. A vevő ezt követően még egyszer megerősítheti a megrendelést, vagy lehetőség van arra, hogy bármely fél elálljon a szerződéstől.

4.12  A fizetendő végösszeg a megrendelés összesítése és visszaigazoló levél alapján minden költséget tartalmaz. Kérjük, a csomagot kézbesítéskor szíveskedjék megvizsgálni, sérülés esetén a csomagot nem köteles átvenni, és a termékeken észlelt sérülés esetén kérje jegyzőkönyv felvételét. Ez esetben ne vegye át a csomagot! Szállításból kifolyó sérülés esetén utólagos, jegyzőkönyv nélküli reklamációt nem áll módunkban elfogadni.

5. A MEGRENDELÉSEK FELDOLGOZÁSA ÉS TELJESÍTÉS A WEBÁRUHÁZBAN

5.1. Bankkártyás fizetésnél a megrendelés teljesítése a fizetés teljesítése után történik meg azt követően, hogy megérkezett a vásárlás összege a bankszámlára. A megrendelések feldolgozása munkanapokon történik általában 9-16 óráig. A megrendelés feldolgozásaként megjelölt időpontokon kívül is van lehetőség a megrendelés leadására, amennyiben az a fenti időn kívül történik, az azt követő munkanapon kerül feldolgozásra.

5.2. Minden esetben visszaigazoljuk e-mailben, hogy mikor teljesítjük megrendelését. Általános teljesítési határidő: 5-10 munkanapon belül. Nem vállalunk felelősséget a vagy rajtunk kívül álló okok miatt történő előzetes bejelentés nélküli változás, késedelem miatt.

5.3. Ha Szolgáltató a szerződésben vállalt kötelezettségét azért nem teljesíti, mert a szerződésben meghatározott termék nem áll rendelkezésére, köteles erről Felhasználót haladéktalanul tájékoztatni, valamint Felhasználó által fizetett összeget haladéktalanul, de legkésőbb harminc napon belül visszatéríteni. E kötelezettség teljesítése Szolgáltatót nem mentesíti szerződésszegése egyéb következményei alól.

5.4 Tudomásul veszem, hogy a(z) Com-Pot Kerámia Kft.. (1084 Budapest, Mátyás tér 4. 2 em. 5.) adatkezelő által a com-pot.hu  compostcomposter.com/compostcomposter.hu felhasználói adatbázisában tárolt alábbi személyes adataim átadásra kerülnek a Stripe Inc, mint adatfeldolgozó részére. 6. ELÁLLÁS JOGA

6.1. Az Európai Parlament és a Tanács 2011/83/EU számú irányelvének, továbbá a fogyasztó és a vállalkozás közötti szerződések részletes szabályairól szóló 45/2014. (II.26.) Kormány rendelet szabályozása értelmében Felhasználó a megrendelt termék kézhezvételétől számított 14 napon belül indokolás nélkül elállhat a szerződéstől, és köteles visszaküldeni a megrendelt terméket.

6.2. Az elállási jog gyakorlására nyitva álló idő attól a naptól számított 14 nap elteltével jár le, amelyen Felhasználó, vagy az általa megjelölt, a fuvarozótól eltérő harmadik személy a terméket átveszi. Ez nem érinti a Felhasználó azon jogát, hogy az e pontban meghatározott elállási jogát a szerződés megkötésének napja és a termék átvételének napja közötti időszakban is gyakorolja. Vita esetén a határidő betartását a Felhasználónak kell bizonyítania.

6.3. A termék visszaküldésének költségét a fogyasztónak kell viselnie, a vállalkozás nem vállalja e költség viselését. A vásárló köteles az elállási jogot jóhiszeműen és tisztességesen gyakorolni.  Amennyiben ez nem így történik, például a vevő a megrendelt termék visszaküldéséről nem haladéktalanul dönt, megkezdi annak használatát, az általa esetlegesen okozott értékcsökkenést meg kell fizetnie.

6.4. Az elállási jog gyakorlása esetén a Felhasználót a termék visszajuttatásának költségén kívül más költség nem terheli, Szolgáltató azonban követelheti a nem rendeltetésszerű használatból adódó anyagi kár megtérítését.

6.5. Szolgáltató a termék visszaérkezését követően a fenti jogszabályok értelmében haladéktalanul, de legkésőbb 14 napon belül visszatéríti a kifizetett összeget a Felhasználó részére, beleértve a szállítási díjat is (kivéve azokat a többletköltségeket, amelyek amiatt merültek fel, hogy a Felhasználó a Szolgáltató által felkínált, legolcsóbb szokásos fuvarozási módtól eltérő fuvarozási módot választott.)

6.6. A visszatérítés során az eredeti ügylet során alkalmazott fizetési móddal egyező fizetési módot alkalmazunk, kivéve, ha Felhasználó más fizetési mód igénybevételéhez kifejezetten a hozzájárulását adja; e visszatérítési mód alkalmazásából kifolyólag Felhasználót semmilyen többletköltség nem terheli.

6.7. Felhasználó köteles az árukat indokolatlan késedelem nélkül, de a szerződéstől való elállására vonatkozó értesítés Szolgáltató részére történő megküldésétől számított 14 napnál semmiféleképpen sem később visszaküldeni vagy Szolgáltató címen leadni.

6.8. Felhasználó akkor tartja be a határidőt, ha a 14 napos időszak letelte előtt visszaküldi, vagy átadja a termék(eke)t. A terméket az alábbi címre kell visszaküldeni:1084 Budapest Mátyás tér 4. 2 emelet 5.

6.9. A fogyasztó kizárólag a termék visszaküldésének közvetlen költségét viseli.

6.10. Felhasználó kizárólag akkor vonható felelősségre az árukban bekövetkezett értékcsökkenésért, ha az az áruk jellegének, tulajdonságainak és működésének megállapításához szükségestől eltérő kezelés miatt következett be.

6.11. Amennyiben Felhasználó élni szeretne elállási jogával, annak jelzését megteheti a Szolgáltató elérhetőségeinek valamelyikén írásban (akár a mellékelt adatlap segítségével), vagy telefonon. A megrendelt terméket postai úton, vagy futárszolgálat segítségével juttathatja vissza Felhasználó a Szolgáltató részére.

6.12. Felhasználónak kiemelten ügyelnie kell a termék rendeltetésszerű használatára, ugyanis a nem rendeltetésszerű használatából eredő károknak megtérítése a Felhasználót terheli!

Milyen termékekre nem vonatkozik az elállási jog?

6.13. Felhasználó egyéb panaszával is megkeresheti Szolgáltatót a jelen Szabályzatban található elérhetőségeken.

6.14. Az elállási jog nem illeti meg vállalkozást/céget, azaz az olyan személyt, aki a szakmája, önálló foglalkozása vagy üzleti tevékenysége körében – tehát nem fogyasztóként, nem végső felhasználóként jár el.

7. JÓTÁLLÁS, SZAVATOSSÁG

A webáruházban fogyasztónak (végső felhasználónak) minősülő vevők részére értékesített termékek, terméktípusoktól és a vételártól függően eltérő, a hatályos jogszabályoknak (151/2003. (IX.22.) Korm. rendelet) megfelelő kötelező jótállási és/vagy szavatossági időt vállal. Az eladó szavatossági és jótállási felelősségére a Ptk.-ban és a 151/2003.(IX.22.) sz. kormányrendeletben foglaltak az irányadóak. A jelenleg érvényes jogszabályok alapján kötelező 1 éves jótállás csak a 151/2003. (IX. 22.) Korm. rendelet mellékletében felsorolt egyes, bruttó 10.000,- Ft. feletti eladási árú termékekre vonatkozik.

9. VEGYES RENDELKEZÉSEK

9.1. Szolgáltató kötelezettsége teljesítéséhez közreműködőt jogosult igénybe venni. Ennek jogellenes magatartásáért teljes felelősséggel tartozik, úgy, mintha a jogellenes magatartást saját maga követte volna el.

9.2. Ha a jelen Szabályzat bármely része érvénytelenné, jogtalanná vagy érvényesíthetetlenné válik, az a fennmaradó részek érvényességét, jogszerűségét és érvényesíthetőségét nem érinti.

9.3. Amennyiben Szolgáltató a Szabályzat alapján megillető jogát nem gyakorolja, a joggyakorlás elmulasztása nem tekinthető az adott jogról való lemondásnak. Bármilyen jogról történő lemondás csak az erre vonatkozó kifejezett írásbeli nyilatkozat esetén érvényes. Az hogy a Szolgáltató egy alkalommal nem ragaszkodik szigorúan a Szabályzat valamely lényegi feltételéhez, vagy kikötéséhez nem jelenti azt, hogy lemond arról, hogy a későbbiekben ragaszkodjon az adott feltétel vagy kikötés szigorú betartásához.

9.4. Szolgáltató és Felhasználó vitás ügyeiket békés úton próbálják rendezni. Az illetékes békéltető testület: a területi gazdasági kamarák mellett működő független testület, melynek célja a fogyasztó és a gazdálkodó szervezet közötti vitás ügy egyezségen alapuló rendezésének megkísérlése.

Fogyasztókkal szembeni tisztességtelen kereskedelmi gyakorlat tilalmáról szóló törvény szerinti magatartási kódex nem áll rendelkezésre.

Kötelezettséget vállalunk az alternatív vitarendezési fórum igénybevételére a fogyasztói jogvitáik rendezéséhez. Az Európai Bizottság által fejlesztett és üzemeltetett online vitarendezési platformot a linkre kattintva érheti el:

Az online vitarendezési platform használata regisztrációt igényel az Európai Bizottság rendszerében, majd bejelentkezés után a fogyasztó benyújthatja panaszát a honlapon keresztül, ha nem sikerült közvetlenül rendeznie a jogvitáját a vállalkozással.

A panasz benyújtását követően az online vitarendezési platform azonnal továbbítja azt az ellenérdekű félnek. Ezt követően az érintetteknek meg kell egyezniük egy alternatív vitarendezési fórumról, amely végső soron el fog járni a közöttük fennálló ügyben. Azokról a fórumokról, amelyek eljárhatnak az esetükben, a platform tájékoztatja a feleket. Amint megszületik a megállapodás a vitarendezési fórumról, az online platform oda továbbítja a panaszt.

Ha a feleknek nem sikerül 30 napon belül megegyezniük, vagy ha a platform sem tud a benyújtott adatok alapján olyan alternatív vitarendezési fórumot azonosítani, amelynek hatásköre van eljárni, a panasz további feldolgozására nem kerül sor.

10. PANASZKEZELÉS RENDJE

10.1. Áruházunk célja, hogy valamennyi megrendelést megfelelő minőségben, a megrendelő teljes megelégedettsége mellett teljesítsen. Amennyiben Felhasználónak mégis valamilyen panasza van a szerződéssel vagy annak teljesítésével kapcsolatban, úgy panaszát az hello@com-pot.hu e-mail címen közölheti.

10.2. Az írásbeli panaszt az webáruházunk 30 napon belül írásban megválaszolja. A panaszt elutasító álláspontját megindokolja. A válasz másolati példányát 3 évig megőrzi, s azt az ellenőrző hatóságoknak kérésükre bemutatja.

11. SZERZŐI JOGOK

11.1. Miután a com-pot.hu,compostcomposter.com/compostcomposter.hu  mint weboldal szerzői jogi műnek minősül, tilos a weboldalon megjelenő tartalmak vagy azok bármely részletének letöltése (többszörözése), újra nyilvánossághoz történő közvetítése, más módon való felhasználása, elektronikus tárolása, feldolgozása és értékesítése a Szolgáltató írásos hozzájárulása nélkül. Ellenkező esetben a hatályos jogszabályok – az 1999. évi LXXVI. törvény, valamint a 2012. évi C. törvény 385.§ – alapján jogi eljárás megindítását kezdeményezzük, továbbá a jogosulatlan felhasználás napidíja is felszámolásra kerül. Ennek díja 300.000 HUF/nap/kép/ videó/ mondat.

11.2. A com-pot.hu compostcomposter.com/compostcomposter.hu  weboldalról és annak adatbázisából bármilyen anyagot átvenni írásos hozzájárulás esetén is csak az adott weboldalra való hivatkozással lehet.

11.3. A Szolgáltató fenntartja minden jogát szolgáltatásának valamennyi elemére, a domain-neveire, az azokkal képzett másodlagos domain nevekre valamint az internetes reklámfelületeire.

13. FELELŐSSÉG KORLÁTOZÁSA

Szolgáltató nem vállal felelősséget semmilyen, az oldal tartalmával kapcsolatos látogatói megjegyzés miatt. Szolgáltató nem azonosul az oldalon ajánlott más weboldalak és linkek által forgalmazott termékekkel és szolgáltatásokkal. Szolgáltató nem vállal felelősséget sem önállóan, sem együttesen mással, semmilyen direkt vagy indirekt panaszért, kárért, ami ezen weboldal tartalmával, hirdetéseivel vagy az oldalon található egyéb weboldal tartalmával kapcsolatos.

Szolgáltató semmilyen módon nem felelős az alább felsorolt pontokban foglaltak miatt, bármilyen okból is következtek be:

• Bármilyen működési hiba az internetes hálózatban, ami megakadályozza a com-pot.hu/compostcomposter.com akadálytalan működését és a vásárlást
• Bármilyen meghibásodás, bármely vételi eszközben a kommunikációs vonalakon
• Bármely levél – függetlenül attól, hogy papír, vagy elektronikus formában érkezett -, de főleg bármilyen adat elvesztése
• Bármely szoftver nem megfelelő működése
• Bármilyen programhiba, abnormális esemény, vagy technikai hiba következményei

A com-pot.hu-t compostcomposter.com/compostcomposter.hu  működtető személy nem vonható felelősségre semmilyen vis maior esetében, vagy bármilyen eseménnyel kapcsolatosan, ami nem az irányítása alatt áll.

Abban az esetben, ha a résztvevő bármilyen formában megsérti a szabályokat, szolgáltató szabadon érvénytelennek nyilváníthatja vásárlását, és a vevő nem jogosult fellebbezni a döntés ellen.
